2. Eligibility
2.1 The Competition is open to Nigerian citizens who are at least eighteen (18) years old at the time of entry, whether resident in Nigeria or abroad, except where participation is prohibited by the law of the jurisdiction from which the Entry is submitted. Eligible adult Participants may submit Entries depicting historical family moments, childhood memories, or images featuring persons who were under eighteen (18) years old at the time the memory was recorded, subject to Clauses 5.5 and 5.6 of these Terms and Conditions.
2.2 Employees, officers and directors of NB Plc, the campaign administrator, their respective subsidiaries and affiliates, and any advertising, media, production, technology or verification service provider directly involved in the Competition, together with members of their immediate families or households, are not eligible to participate.
2.3 For these Terms and Conditions, “immediate family” includes a spouse, parent, child and sibling, whether biological, adopted, step or in-law.
2.4 An Entry must be submitted by the Participant in the Participant’s own name. A person may not enter for another person, use a fictitious or borrowed identity, or submit an Entry through multiple identities.
2.5 A Participant may submit no more than one Entry for the competition.
2.6 Each Participant may receive only one Prize throughout the Competition.
2.7 NB Plc may require a valid government-issued means of identification and such other reasonable evidence as may be necessary to verify age, identity, Nigerian citizenship, eligibility and, where relevant, residence before confirming a Participant as a winner.
2.8 Participation is voluntary and constitutes acceptance of these Terms and Conditions and the Competition privacy notice made available at or before the point of entry.
3. Regulatory Approval, Entry Period and Availability
3.1 The commencement and continued operation of the Competition, the Prizes and all related public communications are subject to all applicable approvals, clearances, permits and conditions by the relevant approving agencies.
3.2 No Entry may be submitted before the Entry Period opens or after it closes. The time recorded by the Competition Website will determine when an Entry was received.
3.3 NB Plc may, where reasonably necessary because an approval is delayed, withheld, varied or made subject to a condition, or because of any applicable law, regulatory direction, court order, security concern, material technical failure or circumstance beyond NB Plc’s reasonable control, postpone the opening date, extend or shorten the Entry Period, postpone the announcement or fulfilment of Prizes, suspend or terminate the Competition, or modify any mechanic as required by a competent authority. Any material change will be communicated through NB Plc’s official channels and, to the fullest extent permitted by law, NB Plc will not incur financial liability to a Participant solely because of such change, postponement, suspension, modification or termination. No amendment, suspension, or termination under this Clause will retrospectively deprive a verified winner of a Prize already validly awarded, except where required by applicable law, a competent regulator, or a court order.
3.4 Participants should rely only on the Competition Website and NB Plc’s verified corporate or campaign channels. No person is authorised to alter these Terms and Conditions, guarantee selection, demand payment or promise any prize or benefit outside the approved Competition mechanics.
4. How to Participate
4.1 To enter, an eligible Participant must, during the Entry Period, visit the Competition Website, complete the required entry form and upload an Entry in accordance with the technical instructions displayed on the Competition Website.
4.2 The Participant must provide accurate contact and eligibility information, including full name, telephone number, email address, age confirmation, country and place of residence, and any other information reasonably required at the point of entry.
4.3 Each Entry must comprise a photograph, video, audio recording or written memory involving NB Plc, any of its brands, activities, platforms or broader impact, together with a description of what happened, where and approximately when the relevant moment occurred, and why the memory remains meaningful to the Participant.
4.4 The Entry must comply with any file-format, file-size, duration, word-count or other technical requirement stated on the Competition Website. NB Plc may reject a file that cannot be opened, viewed, heard or reasonably assessed.
4.5 No purchase, consumption of any NB Plc product, entry fee, subscription, donation, premium-rate message, public vote or other payment is required to enter or receive a Prize.
4.6 Internet access and ordinary data charges imposed by a Participant’s service provider may apply. NB Plc does not receive any part of those charges.
4.7 An Entry is deemed received only when the Competition Website displays or sends a submission confirmation. A draft, failed upload or content posted only on social media is not an Entry unless the approved mechanics expressly state otherwise.
5. Entry Requirements and Content Standards
5.1 Each Entry must be truthful, authentic, original to the Participant or lawfully submitted with the necessary authority, and must contain an Eligible NB Plc Connection capable of reasonable verification.
5.2 A Participant must not use artificial intelligence, synthetic-media software, deepfake technology or any other digital tool to fabricate or materially misrepresent a person, event, voice, image, date, location, product, brand presence or other material fact in an Entry.
5.3 Ordinary technical assistance, including scanning, cropping, compression, stabilisation, colour or exposure adjustment, noise reduction, transcription, translation, subtitling or format conversion, is permitted where it does not materially alter the factual content or meaning of the Entry. The Participant must disclose material restoration or editing if requested by NB Plc.
5.4 A Participant must own the copyright in the Entry or have obtained all permissions and authority required to submit it and grant the rights stated in these Terms and Conditions. Possession of a photograph, video or recording does not by itself establish ownership or authority.
5.5 Where an Entry features any identifiable person other than the Participant, the Participant must, before submitting the Entry, have obtained and must retain all consents, releases, permissions and other authority necessary to submit, verify, edit, publish and use that person’s image, voice, name, story or other personal information in accordance with these Terms and Conditions. Where the person is under eighteen (18) years of age, the Participant must be the person’s parent or legal guardian or must have obtained the prior written consent of the parent or legal guardian. The Participant is responsible for ensuring that all such rights and permissions remain sufficient for the uses authorised under these Terms and Conditions and must be able to produce satisfactory evidence of them where required.
5.6 Where an Entry features or relates to a deceased person, the Participant warrants that the Participant owns, or otherwise has lawful authority to submit and permit the use of, the relevant material in accordance with these Terms and Conditions and shall obtain and retain any consent, permission, release or other evidence of authority necessary for such use.
5.7 An Entry must not: (a) be false, misleading, defamatory, threatening, hateful, discriminatory, obscene or unlawfully intrusive; (b) infringe copyright, trade mark, privacy, publicity, confidentiality or any other right; (c) disclose confidential business, medical, financial, identity or security information; (d) promote unlawful, dangerous or irresponsible conduct; (e) portray underage, excessive or irresponsible alcohol consumption, drinking and driving or intoxication as desirable; (f) where an alcoholic beverage is depicted, feature any identifiable person who was under eighteen (18) years old at the time the photograph, video or other visual material was created; or (g) contain malware, unauthorised advertising, solicitation or political campaigning. By submitting an Entry, the Participant warrants compliance with this Clause.
5.8 The presence of an NB Plc product or brand must be genuine to the memory or story. Participants must not stage a false historical scene, digitally insert an NB Plc product or brand, or otherwise fabricate an Eligible NB Connection.
5.9 Professional production quality is not required. However, an Entry must be sufficiently clear to permit reasonable assessment, verification and, where selected, publication.
5.10 NB Plc may reject, remove from consideration or decline to publish an Entry that does not comply with these Terms and Conditions or that NB Plc reasonably considers unsuitable for the Campaign or inconsistent with applicable law or responsible marketing standards.
5.11 Entries are submitted on a non-confidential basis. Participants should not submit irreplaceable physical originals. Unless otherwise agreed in writing, materials supplied to NB Plc will not be returned.
6. Authenticity, Rights and Anti-Fraud Verification
6.1 Any Entry under consideration for a Prize is subject to identity, eligibility, authenticity, provenance and rights verification before the Participant is confirmed as a winner.
6.2 The burden of establishing the authenticity, provenance, ownership and authority relating to an Entry rests at all times on the Participant. The Participant must obtain and retain sufficient evidence to establish those matters, including, where applicable: (a) the original RAW or highest quality unedited digital source file containing available original EXIF or other embedded metadata; (b) the original physical photograph, print, negative, recording or other source material; (c) a contemporaneous backup, export record, publication, receipt, correspondence or other secondary record; (d) independent witness or documentary corroboration of the date, place, persons or event; and (e) any identification, consent, release, declaration or other evidence relevant to the Participant’s ownership, authority or compliance with these Terms and Conditions. NB Plc may require production of any such material where necessary for verification.
6.3 NB Plc’s failure to request, review or verify any consent, release, permission or evidence of ownership or authority shall not relieve a Participant of any obligation under these Terms and Conditions and shall not constitute an acknowledgement or confirmation by NB Plc that the Participant possesses the required rights or authority.
6.4 NB Plc and its authorised service providers may use manual and technology-assisted methods, including duplicate detection, reverse-image searching, metadata review, content comparison and synthetic-media analysis, to support verification. The output of any technological tool may be considered together with human evaluation, the Entry, the Participant’s explanation and any other information reasonably available to NB Plc. NB Plc’s resulting verification determination is final and binding for the purposes of the Competition and is not subject to any further internal appeal, except for correction of a manifest administrative error and without prejudice to any non-waivable statutory right or direction of a competent regulator or court.
6.5 NB Plc will not require unrestricted access to a Participant’s device, email, social-media account or cloud storage. A Participant may nevertheless be required to provide specific files, records or evidence reasonably relevant to verification.
6.6 Participants must retain the Original Material and relevant supporting evidence until at least ninety (90) days after the announcement of the Selected Stories.
6.7 A Provisional Selected Participant must, within seventy two (72) hours of being notified of provisional selection, provide the Verification Materials required under these Terms and Conditions and any standard verification instructions communicated with the notification. The Participant is responsible for ensuring that the materials provided are complete, accurate and sufficient for verification. Failure to provide satisfactory materials within the applicable period may result in disqualification, unless NB Plc expressly allows additional time.
6.8 NB Plc may reject or disqualify an Entry, withhold confirmation or payment of a Prize, or proceed to another eligible Entry where the available evidence does not satisfactorily establish identity, eligibility, authenticity, ownership, permission or compliance with these Terms and Conditions.
6.9 NB Plc is not required to disclose confidential, security-sensitive or proprietary fraud-prevention, verification or selection methods.
7. Selection and Confirmation of the Eighty Stories
7.1 The Competition is a free, merit-based skill competition. Entries will not be selected by raffle, random draw, lot, chance, fastest-entry mechanism or public vote, and no element of chance will be used to determine a Selected Story or resolve a tie.
7.2 Eligible Entries will be assessed by an odd-numbered Judging Panel comprising at least three (3) appropriately qualified persons appointed by NB Plc. Panel members may be internal or external and should collectively have relevant experience in storytelling or media, Nigerian culture or history, brand or corporate heritage and legal, compliance or verification review.
7.3 Eligible Entries will be assessed independently by the Judging Panel on their overall merit, having regard to their authenticity and verifiability, the strength and relevance of their connection to NB @80 and “Together, Every Moment”, the quality and emotional resonance of the storytelling, their historical, cultural or community value, and their originality and distinctiveness. The Judging Panel will apply these criteria consistently and record the basis of its assessment.
7.4 The selection process will include eligibility and content screening, panel assessment and ranking, preparation of a shortlist and reserve list, verification of identity, authenticity, provenance and rights, and final confirmation of eighty (80) Selected Stories. The selection criteria will not be materially changed after the Entry Period opens unless required by a competent regulator and duly communicated.
7.5 Subject to successful verification, the eighty (80) eligible Entries which, in the reasonable judgment of the Judging Panel, best satisfy the criteria in Clause 7.3 will be selected. The next highest-ranked eligible Entries will form a reserve list and may be considered where a provisionally selected Entry is disqualified, withdrawn, cannot be verified or cannot receive the Prize.
7.6 Where two or more Entries are considered equally meritorious at a relevant selection position, priority will be given to the Entry with the stronger authenticity and verifiability, followed by the stronger NB @80 connection and storytelling quality. Any remaining tie will be resolved by a documented majority decision of the Judging Panel. No random or chance-based tie-breaker will be used.
7.7 No Entry will be finally confirmed as a Selected Story unless the Participant satisfies all applicable eligibility, authenticity, provenance, rights and verification requirements. A favourable assessment does not override a failure to comply with these Terms and Conditions.
7.8 Where a Participant submits or attempts to submit more than one Entry, whether directly or indirectly, including through the use of different email addresses, telephone numbers, identities or proxies, NB Plc may, in its discretion, consider only the first valid Entry received and disregard all subsequent Entries, or disqualify all Entries submitted by or on behalf of that Participant.
7.9 The Judging Panel’s decisions on creative and qualitative assessment, and NB Plc’s decisions on eligibility, verification and administration, are final and binding for the purposes of the Competition, subject to correction of a manifest administrative error.
7.10 NB Plc may appoint an independent observer or auditor and may retain confidential records of panel appointments, declarations of conflict, assessments, rankings, verification outcomes and final selections for regulatory, audit and dispute-resolution purposes.
8. Prizes
8.1 Subject to compliance with these Terms and Conditions and the qualification of eighty (80) eligible entrants, eighty (80) verified winners will each receive one Cash Prize of ₦1,000,000.00 and one Product Prize comprising twenty (20) cases of NB Plc products.
8.2 NB Plc will not transfer the Cash Prize to a foreign bank account or in a foreign currency and is not responsible for any onward international wire fee, currency-conversion loss, foreign banking restriction, foreign tax or other cost incurred by a winner after payment to the verified Nigerian account.
8.3 The Product Prize will be made available for collection at designated collection(s) point in Nigeria to be communicated by NB Plc. A winner resident outside Nigeria must, within thirty (30) days of the first Prize notification, nominate an adult proxy authorised to collect the Product Prize on the winner’s behalf and provide any identification or authorisation required by NB Plc. Collection by the authorised proxy constitutes collection by the winner and fully discharges NB Plc’s obligation in respect of the Product Prize. Failure to nominate a proxy or collect the Product Prize within the period specified by NB Plc may result in forfeiture without cash substitution or compensation. Delivery or release of the Product Prize to the winner’s authorised proxy constitutes delivery to the winner and fully discharges NB Plc’s obligation in respect of that Product Prize.
8.4 NB Plc reserves the absolute right, in its discretion and subject to applicable regulatory requirements, to fulfil all or any part of the Product Prize exclusively with non-alcoholic beverages, including where the Selected Story concerns a non-alcoholic brand, where the winner requests non-alcoholic products, or where non-alcoholic fulfilment is considered appropriate for legal, responsible-marketing, availability, delivery or other operational reasons. NB Plc may also substitute an unavailable brand, pack size or assortment with another NB Plc product of reasonably comparable or greater value.
8.5 No winner will be required to pay a processing fee, claim fee, tax deposit or other amount, or disclose a PIN, password or one-time banking code, to receive a Prize.
8.6 NB Plc is not required to award a Prize to a person who is ineligible or fails verification. Any Prize that cannot be awarded after the approved selection and reserve-list process has been exhausted will be dealt with in accordance with applicable regulatory direction.
8.7 No additional prize or reward is available unless it is expressly described and allocated in regulator-approved Competition materials.
9. Winner Notification, Final Verification and Fulfilment
9.1 Provisional Selected Participants will be contacted using the telephone number or email address supplied with the Entry. NB Plc will not request a fee, PIN, password or one-time banking code.
9.2 NB Plc and/or the campaign administrator will make up to three (3) reasonable attempts to contact a Provisional Selected Participant by telephone or email within seventy-two (72) hours of the first attempt. If the Participant cannot be reached, fails to respond within that period, declines the Prize, fails verification or is disqualified, NB Plc may proceed to the next eligible Entry on the reserve list.
9.3 Before confirmation, a Provisional Selected Participant must provide valid government-issued identification, details of a qualifying Nigerian commercial-bank account held in the same verified name, required Verification Materials and any documentation reasonably necessary for regulatory, audit, tax, rights-clearance or anti-fraud purposes.
9.4 The name on the Entry, identification document and payment evidence must reasonably correspond. NB Plc may reject an Entry where identity, age, Nigerian citizenship, eligibility, rights or payment ownership cannot be established satisfactorily.
9.5 Subject to successful verification and receipt of complete and accurate documentation, NB Plc will use reasonable efforts to pay the Cash Prize within ten (10) business days after final confirmation and make the Product Prize available for collection within thirty (30) days after final confirmation.
9.6 A successful transfer of the Cash Prize, release, or valid forfeiture of the Product Prize in accordance with these Terms and Conditions constitutes full discharge of NB Plc’s Prize obligation to that winner
9.7 Where payment or collection is delayed because the winner supplied incorrect, incomplete or unsuitable information, the winner must provide corrected information within the period specified by NB Plc. Otherwise, the affected Prize component may be treated as unclaimed or forfeited, subject to applicable regulatory requirements.
9.8 The Selected Stories are scheduled to be revealed on 16 November 2026 or any other approved date communicated through NB Plc’s official channels.
10. Copyright, Permissions and Use of Entries
10.1 The Participant retains ownership of any copyright the Participant lawfully owns in the Entry.
10.2 By submitting an Entry, the Participant grants NB Plc, its affiliates and appointed service providers a non-exclusive, royalty-free licence during the Competition and for so long as reasonably necessary to host, copy, format, technically adapt, review, assess, verify, secure, display internally, provide to regulators and auditors and otherwise use the Entry as reasonably necessary to administer the Competition, investigate complaints and comply with applicable law.
10.3 Where a Participant has provided the applicable consent at the point of submission, NB Plc may use a non-selected Entry for corporate communications, archival, publicity, advertising and other promotional activities within the scope of that consent, without requiring any further or separate permission from the Participant. Any withdrawal of consent will apply prospectively and will not affect any use or processing lawfully undertaken before the withdrawal.
10.4 If an Entry becomes a Selected Story, the winner grants NB Plc, its affiliates, successors and appointed advertising, media, public relations, production, event and archive partners a non-exclusive, worldwide, royalty-free, transferable and sublicensable licence to reproduce, edit, crop, resize, translate, subtitle, dub, adapt, combine with other material, superimpose text, graphics, campaign marks or logos on, publish, communicate and display the Selected Story in connection with NB@80, “Together, Every Moment”, winner announcements, corporate heritage, corporate communications, archival, publicity, advertising and other promotional activities. Such use may be undertaken without further or separate permission from the winner, within the scope of the rights and consent granted under these Terms and Conditions. To the fullest extent permitted by applicable law, the winner waives and agrees not to assert any moral right or similar right that would prevent or restrict an act authorised by this Clause; where any such right is not capable of waiver, the winner consents to those acts and undertakes not to object to them merely because the Selected Story has been edited, formatted, adapted or combined as authorised.
10.5 NB Plc may permanently retain an archival copy of an Entry and related rights and verification records as part of its corporate or commemorative archive. Archival retention does not, by itself, confer any right of public, advertising or promotional use beyond the scope of the rights, permissions and applicable consent granted by the Participant under these Terms and Conditions.
10.6 NB Plc may make editorial, technical and creative changes for length, clarity, translation, formatting, cropping, subtitling, dubbing, technical quality, campaign branding, brand safety and legal compliance, and may overlay logos, captions, graphics or other campaign elements. NB Plc will not knowingly use a Selected Story in a manner that falsely attributes authorship or is deliberately prejudicial to the honour or reputation of its author. NB Plc will determine the format, timing, duration and channels of publication and does not guarantee that every Selected Story will appear in every listed medium.
10.7 No additional compensation will be payable to a Participant for any use of an Entry undertaken within the scope of the rights and permissions granted under these Terms and Conditions and any applicable consent provided by the Participant. In the case of a Selected Story, the Prize constitutes the full consideration for the rights granted in respect of that Selected Story unless a separate written agreement expressly provides otherwise.
10.8 The Participant warrants that, before submitting the Entry, they possess and have obtained all ownership rights, authority, permissions, consents, releases and other rights necessary to submit the Entry and permit its use in accordance with these Terms and Conditions. The Participant must retain satisfactory evidence of those rights and permissions for as long as the Entry may be used under these Terms and Conditions and must produce such evidence where reasonably required for verification, complaint handling, regulatory purposes or the defence of any claim.
10.9 The Participant will fully indemnify and keep indemnified NB Plc, its affiliates, officers, employees and appointed service providers against every third-party claim, demand, action, liability, loss, damage, penalty, settlement and reasonable legal or professional cost arising from or connected with: (a) any breach of, or failure by the Participant to satisfy, the Participant’s warranties or obligations concerning ownership, authority, authenticity, permissions, consents, releases, rights clearance or the obtaining, retention or production of evidence required under these Terms and Conditions; (b) any allegation that the Entry or its authorised use infringes copyright, privacy, image, voice, publicity, confidentiality, defamation or another right; or (c) any false or misleading statement made by the Participant. This indemnity does not apply to the extent that a claim results directly from NB Plc’s use of the Entry outside the rights granted under these Terms and Conditions or from NB Plc’s wilful misconduct.
10.10 Submission of an Entry does not prevent NB Plc from using material, themes or ideas that NB Plc already possessed or independently receives or develops, provided NB Plc does not unlawfully copy the Participant’s protected expression.
11. Personal Data and Privacy
11.1 Personal data supplied or generated in connection with the Competition may be processed by NB Plc, the campaign administrator and authorised service providers as reasonably necessary to receive and administer Entries, verify eligibility and authenticity, prevent fraud, contact Participants, fulfil Prizes, publish Selected Stories, handle complaints and comply with legal, regulatory, tax and audit requirements.
11.2 Participants must provide accurate and current information and should not include identification documents, bank details, passwords, one-time banking codes, health information or other unnecessary sensitive information in an Entry or any public-facing submission. Information required for verification or payment will be requested through an approved channel.
11.3 Where an Entry contains the image, voice, name, story or other personal data of another person, the Participant confirms that, before submission, the Participant has obtained and will retain all authority, consent, permission or release necessary for the submission and any use authorised under these Terms and Conditions. The Participant remains solely responsible for ensuring that the inclusion and authorised use of such personal data is lawful and properly authorised.
11.4 Personal data may be disclosed, to the extent reasonably necessary for the Competition, to the campaign administrator, verification, technology, production, communication and payment service providers, professional advisers, auditors, regulators and law-enforcement authorities, subject to applicable data-protection and confidentiality requirements.
11.5 NB Plc and its authorised service providers will take reasonable and appropriate measures to protect personal data processed for the Competition. Personal data and Competition records may be retained for as long as reasonably necessary for the purposes for which they were collected and for applicable legal, regulatory, tax, audit, fraud-prevention, rights-clearance, complaint and dispute-resolution requirements.
11.6 Participation does not, by itself, constitute consent to receive unrelated direct marketing. Any separate marketing communication will be undertaken only on an appropriate lawful basis.
11.7 Further information about personal-data processing, applicable rights and contact channels will be set out in the Competition privacy notice made available at or before the point of entry.
12. Announcement and Winner Publicity
12.1 A Participant acknowledges that an Entry confirmed as a Selected Story may be published and used in accordance with Clause 10.
12.2 NB Plc may publish a verified winner’s name, general location, story title or description, Selected Story and Prize through the Competition Website, NB Plc’s official channels, films, editorial features, social media, outdoor displays, anniversary experiences, public-relations communications and its commemorative archive.
12.3 NB Plc may determine the sequence, format, timing and channels in which Selected Stories are presented. Selection does not guarantee publication in every campaign asset or medium.
12.4 NB Plc may invite a verified winner to participate in additional photographs, filming, interviews, testimonials, events or documentary content. Any use materially extending beyond the Selected Story and ordinary winner announcement will be governed by an appropriate separate consent or release. Declining an optional additional activity will not invalidate the winner’s entitlement to the Prize.
12.5 Where a Selected Story includes another identifiable person, public use is subject to any required release, consent or other lawful basis. NB Plc may blur, crop, omit or decline to publish any person or element where the necessary permission cannot be established.
12.6 A winner must not falsely represent that NB Plc, any NB Plc brand or any regulator has endorsed the winner, the winner’s business or any product or service beyond the fact of selection in the Competition.
13. Disqualification and Competition Integrity
13.1 NB Plc may disqualify or suspend an Entry where there are reasonable grounds to suspect false identity, impersonation, plagiarism, infringement, fabricated evidence, undisclosed material manipulation, duplicate or coordinated submissions, collusion, bribery, harassment, interference with selection or verification, or any other conduct that undermines the lawful or fair operation of the Competition.
13.2 A Prize may be withheld while a genuine eligibility, authenticity, rights or fraud concern is investigated. NB Plc may request further information and may make a final determination on the evidence reasonably available within the applicable regulatory framework.
13.3 If fraud, material ineligibility or a breach of the Participant’s warranties is discovered after payment or delivery, NB Plc may seek recovery of the Cash Prize, the Product Prize or its reasonable value and take any other lawful action.
13.4 Assistance from a family member, digitisation provider, translator or production professional is not prohibited where the Participant remains the genuine entrant, the assistance does not fabricate or materially misrepresent the story, and material assistance is disclosed if requested.
14. General Conditions and Liability
14.1 NB Plc will administer the Competition in accordance with the approved mechanics, these Terms and Conditions and applicable law, while retaining reasonable discretion in relation to eligibility, verification, administration, publication and Prize fulfilment.
14.2 NB Plc is not responsible for an Entry that is lost, delayed, corrupted or not received because of a Participant’s device, internet connection, incorrect contact information or a third-party network or platform outside NB Plc’s reasonable control. Where a material failure occurs within an appointed system, NB Plc may take such reasonable and regulator-approved steps as it considers appropriate.
14.3 To the fullest extent permitted by law, NB Plc will not be liable for indirect or consequential loss arising from participation or for delay or failure caused by telecommunications networks, banks, payment intermediaries, power failure, civil disturbance, natural events, government action or another event beyond NB Plc’s reasonable control. Nothing in these Terms and Conditions excludes liability that cannot lawfully be excluded.
14.4 Each Participant bears the costs of preparing and submitting an Entry and supplying Verification Materials. NB Plc is not obliged to reimburse travel, accommodation, production, digitisation, delivery, customs, banking or other costs unless expressly agreed in writing.
14.5 NB Plc’s verification process is conducted solely to determine eligibility, provenance, and legal compliance for the Competition. Selection or publication of a story does not constitute NB Plc’s independent verification, warranty, or endorsement of every opinion, recollection, or factual assertion contained in a Selected Story.
14.6 If any provision of these Terms and Conditions is held invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law. A failure or delay by NB Plc to enforce a provision does not amount to a waiver.
15. Complaints and Dispute Resolution
15.1 Questions or complaints should first be submitted to NB Plc Consumer Care on 0800-600-0000 or Consumercare@nbplc.com, together with the Participant’s name, contact details, Entry reference number and relevant supporting information.
15.2 NB Plc will acknowledge, investigate and respond to complaints within a reasonable period, taking account of the nature and urgency of the complaint and any applicable regulatory timeframe.
15.3 Any dispute not resolved amicably may be referred by mutual agreement to mediation at an appropriate Multi-Door Courthouse in Nigeria before court proceedings, without prejudice to either party’s right to seek urgent, statutory or other lawful relief.
16. Responsible Marketing and Alcohol-Related Content
16.1 The Competition is strictly for persons aged eighteen (18) years and above. A Participant who fails age verification is not eligible to receive a Prize.
16.2 No purchase or consumption of alcohol is required to enter or be selected. Participants are not required to create or recreate a memory by consuming alcohol for the purpose of submitting an Entry.
16.3 No Entry depicting an alcoholic beverage may feature any identifiable person who was under eighteen (18) years old at the time the photograph, video or other visual material was created.
16.4 NB Plc reserves the absolute right, in its discretion, to fulfil the Product Prize wholly with non-alcoholic beverages, including where the Selected Story concerns a non-alcoholic brand, where the winner requests non-alcoholic products or where NB Plc considers non-alcoholic fulfilment appropriate for responsible-marketing, legal, regulatory, delivery, availability or other operational reasons. No winner has a right to demand any particular alcoholic brand or product assortment.
16.5 A Selected Story will not be published where it depicts or encourages underage drinking, excessive or irresponsible consumption, drinking and driving, intoxication as desirable or any other portrayal inconsistent with applicable responsible-marketing standards.
17. Governing Law and Regulatory Approval
17.1 These Terms and Conditions are governed by the laws of the Federal Republic of Nigeria, without prejudice to any mandatory law applicable to an eligible Participant resident outside Nigeria.
17.2 The commencement and continued operation of the Competition are subject to all required approvals and any conditions imposed by a competent regulator.
17.3 The Competition is intended and must be administered as a free, merit-based skill competition using the published criteria in Clause 7 of these Terms and Conditions. No purchase requirement, subscription, public vote, raffle, random draw, lot, chance-based selection, premium-rate message or paid entry method may be introduced without fresh legal and regulatory review and every approval or State/FCT permit required by the affected jurisdiction.
18. Participant Declarations and Consents
18.1 Before submitting an Entry, the Participant must complete the mandatory declarations and consents presented on the Competition Website, including confirmation of acceptance of these Terms and Conditions. By accepting these Terms and Conditions, the Participant makes and accepts the applicable declarations, warranties, obligations and consents set out in this Clause 18.
